These Terms & Conditions form a binding agreement between Recycle the Label Ltd, Est 2020 (“we”, “us”, or “the Company”) and the Consignor (“you”). By submitting items for consignment, you acknowledge and agree to the terms outlined below.

1. ACCEPTANCE OF TERMS

By opening an account or providing items for assessment, you agree to be bound by these Terms & Conditions. Recycle the Label may update or amend these terms at any time. The most current version will be available on our website.

2. CONSIGNOR ACCOUNT & IDENTIFICATION

• You are responsible for maintaining the confidentiality and security of your account information and login details.
• Any activity conducted through your account will be considered authorised by you.

3. ITEM ASSESSMENT, ACCEPTANCE & PROCESSING

• Acceptance of items is solely at the discretion of Recycle the Label.
• Items that do not meet our quality, brand, authenticity, or seasonal criteria will be declined.
• Declined items must be collected within 7 days of notification. If not collected, they will automatically be donated to a partnered charitable organisation.
• This collection window applies only to unaccepted items; expired or unsold items at the end of the consignment period will not be held aside.
• A processing fee of $1 per accepted item on drop-off applies.
• You will receive an email once items are accepted for consignment, and your account will reflect the status of each item.

4. OWNERSHIP & AUTHENTICITY

• By consigning items, you confirm you are the legal owner or have explicit permission to sell them.
• All high-end or luxury designer items must be accompanied by proof of authenticity.
• If authenticity cannot be verified, items may be priced conservatively.
• If an item is later proven counterfeit or misrepresented, you agree to reimburse any associated costs, including refunds or authentication fees.

5. PRICING, SALES & COMMISSION STRUCTURE

• Pricing is determined by Recycle the Label based on market demand, condition, and brand.
• Consignor Commission is 45% after GST (Commencing 01/01/26)
• Items remain available for sale for 9 weeks. Items selected for online sale may appear online first before being placed in-store for the remainder of the consignment period.

6. PAYOUTS, ACCOUNT BALANCE & EXPIRY

• You are responsible for monitoring your account, checking sales, and requesting payouts.
• Payments will be processed within 3-7 days of a valid payout request.
• Uncollected balances expire 2 years after the last sale.

7. UNSOLD ITEMS, EXPIRY & WITHDRAWALS

• You may withdraw items at any time before the consignment period ends by collecting them in-store and informing staff.
• Items not retrieved by the end of the 9-week consignment period become the property of Recycle the Label and may be donated.
• Some selected items may be routed through charitable partner stores, with proceeds supporting our chosen community organisations.

8. LIABILITY, RISK & NOTIFICATIONS

• While we take reasonable care of all consigned items, Recycle the Label is not liable for loss, theft, or damage.
• You are responsible for tracking your items, sale status, and balances.
• Automated emails or notifications are provided as a courtesy and are not guaranteed. Failure to receive them does not constitute liability on our part.

9. AMENDMENTS & GOVERNING LAW

• Recycle the Label reserves the right to modify these terms at any time without prior notice.
• These Terms & Conditions are governed by the laws of New Zealand.

By consigning items with Recycle the Label, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
